Please read these Terms and Conditions carefully before accessing or using our website. By accessing or using any part of the site, you engage in our “Service” or “Product and agree to be bound by these Terms and Conditions, including those additional Terms and Conditions and policies referenced herein and/or available by hyperlink. If you do not agree to all the Terms and Conditions of this agreement, then you may not access the website or use any services. If these Terms and Conditions are considered an offer, acceptance is expressly limited to these Terms and Conditions. Any new features or tools which are added to the current store shall also be subject to the Terms and Conditions.

Brew Export UK Limited reserves the right to update, change, or replace any part of these Terms and Conditions by posting updates and/or changes to our website. It is your responsibility to check this page periodically for changes. Your continued use of or access to the website following the posting of any changes constitutes acceptance of those changes. 

These Terms and Conditions apply to all users of the site, including without limitation users who are browsers, vendors, customers, merchants, and/ or contributors of content.

Brew Export UK Limited reserves the right to refuse Services or Products to anyone for any reason at any time. You understand that your content (not including credit card information), may be transferred unencrypted and involve (a) transmissions over various networks; and (b) changes to conform and adapt to technical requirements of connecting networks or devices. Credit card information is always encrypted during transfer over networks. You agree not to reproduce, duplicate, copy, sell, resell or exploit any portion of the Services and Products, use of the Services and Products, or access to the Service and Products or any contact on the website through which the Services or Products are provided, without express written permission by us. 

Shopify

The Brew Export UK Limited site and store is hosted on Shopify Inc., and they provide us with the online e-commerce platform that allows us to sell our products and services to you.

Your data is stored through Shopify’s data storage, databases, and the general Shopify application. They store your data on a secure server behind a firewall.

Age Restriction

You must be over 18 years of age to purchase any of the alcoholic products that we stock. By placing an order with us that includes alcohol, you are confirming that you understand these terms and that you are over the age of 18. It is an offence to sell alcohol to anyone under the age of 18 in the UK.

If you are buying alcohol for someone else the recipient also has to be 18 or older.

Deliveries must be accepted by a person aged 18 or older. If our couriers are in any doubt about the age of the recipient on delivery, they will request some form of ID. We reserve the right to cancel the delivery if the age and identity of the recipient is in doubt.

Alcohol 

Alcohol is best enjoyed in moderation.

Orders

If we are unable to fulfill the whole of your order for any reason and have to replace some items - the items will be swapped and you will be notified via contact email address provided on your order about the unfulfillment. We will always replace items of similar value/size/type. If there’s more than 3 items that we can’t fulfill with your order, we reserve the right to hold off on your order and contact you for further instructions on how you would like to proceed.

If we feel that your order has been placed with the intention to resell the beer at a higher markup your order will be cancelled. This platform is a retail sales outlet for the public to purchase our beers. This is not a wholesale platform. We can not provide invoices for orders placed on this website. All orders will be delivered with a digital receipt of purchase.

Payment will be taken via Shopify at the time of placing an order.

Pre-Orders

If you have placed an order for any items that were on Pre-Order basis, please ensure that you make a note of the targeted shipping date and that this might be subject to change. If there are any significant delays on pre-ordered items (more than 2 weeks delayed), we will contact you immediately to give an up to date estimate.

Payment will be taken via Shopify at the time of placing a pre-order. 

Products and Services 

Certain Products or Services may be available exclusively online through the website. These products or services may have limited quantities. We have made every effort to display as accurately as possible the colors and images of our products that appear at the store. We cannot guarantee that your computer monitor’s display of any color will be accurate. We reserve the right, but are not obligated, to limit the sales of our products or Services to any person, geographic region, or jurisdiction. We may exercise this right on a case-by-case basis. We reserve the right to limit the quantities of any products or services that we offer. All descriptions of products or product pricing are subject to change at any time without notice, at the sole discretion of Brew Export UK Limited. We reserve the right to discontinue any product at any time. Any offer for any product or service made on this site is void where prohibited. We do not warrant that the quality of any products, services, information, or other material purchased or obtained by you will meet your expectations, or that any errors in the Service or Product will be corrected.

Administrative and Restocking Fee

If your pre-order total is under £80 and shipping invoices have not been paid for more than 4 weeks and we have sent the invoice 3 times, we reserve the right to refund your pre-order minus a 15% administrative and restocking fee. 

Mishandling

Customers accept responsibility for the safe storage and use of the products upon receipt. Brew Export UK Limited is not liable for damage caused by customer mishandling. 

Returns 

For logistical reasons, Brew Export UK Limited does not accept returns. 

Damage

Damaged or missing goods will be refunded or replaced with an item of similar value/size/type.

Failed Deliveries 

We cannot accept responsibility for delivery failure if you provide an incorrect address and postal code or incorrect contact telephone number. Please check this information when placing your order.

This does not affect your statutory rights.

Cancellation

Pre-orders and subscriptions are not eligible for returns or refunds after shipping.

If, at Brew Export UK Limited request, you send certain specific submissions (for example contest entries) or without a request from us you send creative ideas, suggestions, proposals, plans, or other materials, whether online, by email, by postal mail, or otherwise (collectively, ‘comments’), you agree that we may, at any time, without restriction, edit, copy, publish, distribute, translate and otherwise use in any medium any comments that you forward to us. We are and shall be under no obligation (1) to maintain any comments in confidence; (2) to pay compensation for any comments; or (3) to respond to any comments. We may, but have no obligation to, monitor, edit or remove content that we determine in our sole discretion are unlawful, offensive, threatening, libelous, defamatory, pornographic, obscene or otherwise objectionable or violates any party’s intellectual property or these Terms and Conditions. You agree that your comments will not violate any right of any third-party, including copyright, trademark, privacy, personality or other personal or proprietary right. You further agree that your comments will not contain libelous or otherwise unlawful, abusive or obscene material, or contain any computer virus or other malware that could in any way affect the operation of the Service or any related website. You may not use a false email address, pretend to be someone other than yourself, or otherwise mislead us or third-parties as to the origin of any comments. You are solely responsible for any comments you make and their accuracy. We take no responsibility and assume no liability for any comments posted by you or any third-party.

Modifications to Services and Prices

Prices for our products are subject to change without notice. We reserve the right at any time to modify or discontinue the Service or Products (or any part or content thereof) without notice at any time. We shall not be liable to you or to any third-party for any modification, price change, suspension or discontinuance of the Service and Products.

Accuracy of Billing and Account Information

Brew Export UK Limited reserves the right to refuse any order you place with us. We may, in our sole discretion, limit or cancel quantities purchased per person, per household, or per order. These restrictions may include orders placed by or under the same customer account, the same credit card, and/or orders that use the same billing and/or shipping address. In the event that we make a change to or cancel an order, we may attempt to notify you by contacting the email and/or billing address/phone number provided at the time the order was made. We reserve the right to limit or prohibit orders of any kind and without any endorsement. We shall have no liability whatsoever arising from or relating to your use of optional third-party tools. Any use by you of optional tools offered through the site is entirely at your own risk and discretion and you should ensure that you are familiar with and approve of the terms on which tools are provided by the relevant third-party provider(s). We may also, in the future, offer new services and/or features through the website (including, the release of new tools and resources). Such new features and/or products and/or services shall also be subject to these Terms and Conditions.

Certain content, products, and services available via our Service may include materials from third-parties. Third-party links on this site may direct you to third-party websites that are not affiliated with us. We are not responsible for examining or evaluating the content or accuracy and we do not warrant and will not have any liability or responsibility for any third-party materials or websites, or for any other materials, products, or services of third-parties. We are not liable for any harm or damages related to the purchase or use of goods, services, resources, content, or any other transactions made in connection with any third-party websites. Please review carefully the third-party’s policies and practices and make sure you understand them before you engage in any transaction. Complaints, claims, concerns, or questions regarding third-party products should be directed to the third-party.

Taxes and Other Charges

As these orders are paid for in the UK, VAT is payable on all online shop orders regardless of the final destination country. 

These terms and conditions do not affect your statutory rights.

Sales Items

Sale items cannot be refunded.

Online Competitions 

Entry is open to residents of the UK only. 

The entrant(s) must be aged 18 or over.

All entrants must be willing to provide full name and contact details and to have these details passed to the Promoter of the prizes.  

Use of a false name or address may result in disqualification.  

All entries must be made directly by the person entering the competition.  

Entries made online using methods generated by a script, macro, or the use of automated devices will be void.  

No responsibility can be accepted for entries lost, delayed, or corrupted, or due to computer error in transit.  

The prizes are as stated, are not transferable to another individual and no cash or other alternatives will be offered.  

Prizes are subject to availability and the prize suppliers' terms and conditions.  

The Promoter reserves the right to amend or alter the terms of competitions at any time and reject entries from entrants not entering into the spirit of the competition.  

In the event of a prize being unavailable, the Promoter reserves the right to offer an alternative prize of equal or greater value.  

The winner(s) agree(s) to the prospective use of their name, photograph, and disclosure of county of residence and will cooperate with any other reasonable requests by Brew Export UK Limited relating to any post-winning publicity.  

Unless stated otherwise the winner(s) will be drawn by the Promoter at random from all correct entries received by the closing date stated within the promotional material.  

Reasonable efforts will be made to contact the winner(s). If the winner(s) cannot be contacted, or are unable to comply with these terms and conditions, the Promoter reserves the right to offer the prize to the next eligible entrant drawn at random, or in the event that the promotion is being judged the Promoter reserves the right to offer the prize to the runner(s)-up selected by the same judges.  

Failure to respond and/or provide an address for delivery, or failure to meet the eligibility requirements may result in forfeiture of the prize. 

Where applicable, the decision of the judges is final based on the criteria set out in the promotion and no correspondence will be entered into over this decision. 

Competitions may be modified or withdrawn at any time.

Indemnification

In the event that any provision of these Terms and Conditions are determined to be unlawful, void, or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.

Termination

The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes. These Terms and Conditions are effective unless and until terminated by either you or Brew Export UK Limited. You may terminate these Terms and Conditions at any time by notifying us that you no longer wish to use our Services or Products, or when you cease using our site. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms and Conditions, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services and Products (or any part thereof).

Entire Agreement

The failure of Brew Export UK Limited to exercise or enforce any right or provision of these Terms and Conditions shall not constitute a waiver of such right or provision. These Terms and Conditions and any policies or operating rules posted by us on this site or in respect to The Service constitutes the entire agreement and understanding between you and us and govern your use of the Service, superseding any prior or contemporaneous agreements, communications and proposals, whether oral or written, between you and us (including, but not limited to, any prior versions of the Terms of Service). Any ambiguities in the interpretation of these Terms and Conditions shall not be construed against the drafting party.

Governing Law

These Terms and Conditions and any separate agreements whereby Brew Export UK Limited provide you Products or Services shall be governed by and construed in accordance with the laws of the United Kingdom.
